Ukraine Recognizes Electronic Documents with Full Legal Force
Ukrainian legislation confirms that electronic primary documents and contracts hold the same legal validity as their paper counterparts, provided they meet specific requirements.
The portal Deals has published an article confirming the full legal force of electronic primary documents and contracts in Ukraine. According to Ukrainian legislation, such documents are entirely lawful if they comply with established requirements.
Current Ukrainian legislation, including the Tax Code, the Laws of Ukraine “On Electronic Documents and Electronic Document Management,” “On Electronic Trust Services,” and “On Accounting and Financial Reporting in Ukraine,” allows for the creation and circulation of primary documents in electronic form. For these to be recognized by tax authorities and other institutions, it is necessary to adhere to established requirements regarding mandatory requisites and the use of a qualified electronic signature (QES).
Properly executed electronic documents possess the same legal force as their paper equivalents. This applies to both primary documentation and contracts. It is important to remember that businesses are obligated to produce paper copies of electronic documents at their own expense upon the request of other participants in business transactions, law enforcement agencies, or regulatory bodies.
