Ukraine’s Electronic Document Flow: Regulation and Implementation
Electronic document management in Ukraine holds full legal validity and is governed by several laws, making its implementation relevant for companies.
The publication Deals has released an article focusing on the regulation and organization of electronic document management (EDM) in Ukraine. According to Ukrainian legislation, properly formatted electronic documents with required details (legal entity name, document type, date, electronic signature or seal) possess the same legal force as their paper counterparts. This is supported by the laws ‘On Electronic Documents and Electronic Document Management,’ ‘On Electronic Digital Signature,’ ‘On Electronic Trust Services,’ and ‘On Accounting and Financial Reporting.’
To effectively organize EDM within an enterprise, companies are advised to develop internal regulations. These include a Regulation on Electronic Document Management, which details the procedures for creating, processing, storing, and destroying documents, as well as an Order on the Implementation of Electronic Document Management, which approves the transition to EDM and designates responsible individuals.
The EDM implementation process typically involves several key stages: selecting a suitable document management system, developing internal instructions and training staff, providing employees with qualified electronic signatures (QES), informing counterparties about the transition, and issuing the final order for EDM.
