Ukraine’s Electronic Court and E-Contracts: Key Business Changes
Ukraine is implementing a unified judicial information and telecommunication system, transforming business interactions with courts.
The publication Deals has released an article detailing the implementation of the Unified Judicial Information and Telecommunication System (UJITS) in Ukraine, commonly known as the ‘electronic court.’ This initiative, mandated by Law of Ukraine No. 2147-VIII, aims to modernize the judicial process and simplify interactions between parties and the courts.
UJITS requires mandatory registration for lawyers, notaries, private enforcement officers, arbitration managers, forensic experts, government bodies, and state and communal economic entities. Other individuals can register voluntarily. The system allows for the electronic submission of claims and other procedural documents, as well as the receipt of court decisions and other documents at official electronic addresses.
Law No. 2147-VIII has, for the first time at the legislative level, defined ‘electronic evidence.’ This refers to information in an electronic (digital) format containing data about the circumstances of a case, including electronic documents, websites, text and multimedia messages, metadata, and databases. Electronic evidence can be provided in its original form or as an electronic copy certified by an electronic digital signature (EDS), which is equivalent to a handwritten signature.
