Ukraine’s E-Court: Mandatory for Businesses
As of February 20, 2024, private legal entities must register electronic cabinets in the Unified Judicial Information and Telecommunication System (YeSITS).
The media resource Deals has published an article discussing the mandatory use of the electronic court (E-court) system for businesses in Ukraine. The E-court is a key subsystem of the Unified Judicial Information and Telecommunication System (YeSITS), facilitating the exchange of procedural documents electronically and providing access to case information.
Legislative changes, particularly Law No. 3200-IX of June 29, 2023, have made the registration and use of electronic cabinets in YeSITS mandatory for various court participants. Starting October 18, 2023, this applied to lawyers, notaries, government bodies, and public legal entities. As of February 20, 2024, the registration obligation has been extended to private legal entities involved in civil and administrative cases. Failure to comply can lead to negative procedural consequences, such as documents being left without movement or consideration.
For Ukrainian businesses and the Intecracy Group audience, the implementation of the E-court offers several significant advantages:
- Accelerated and Transparent Processes: The digitalization of court proceedings supports the paperless principle, reduces bureaucracy, enhances transparency, and improves the efficiency of interaction with judicial authorities, minimizing corruption risks.
- Accessibility and Flexibility: The ability to participate in court hearings via video conference and submit documents online ensures business continuity, especially during martial law or other crisis situations, allowing companies to effectively protect their interests regardless of their physical location.
- Data Security and Preservation: The transition to electronic document management and data storage in YeSITS helps prevent the loss of crucial documentation, which is vital for enterprises that have experienced the destruction of paper archives during the war.
The overall trend towards digitalization in Ukraine makes the use of electronic tools an integral part of modern business. The E-court represents a significant step in this direction, simplifying interactions with the state and increasing the efficiency of legal processes.
