Qualified Electronic Signature: Key Aspects for Ukrainian Business

An overview of the key aspects of qualified electronic signatures (QES) and their usage requirements in Ukraine.

The publication Deals has released an article focusing on the qualified electronic signature (QES), explaining its nature and important aspects of its use in Ukraine. This type of electronic signature is the most reliable, possessing the legal force of a handwritten signature.

A QES is created using the owner’s private key and verified with the public key. This mechanism ensures a high level of security, guaranteeing the impossibility of signature forgery and the integrity of the signed document. This makes QES an indispensable tool for secure electronic document management.

According to Resolution of the Cabinet of Ministers of Ukraine No. 749, state bodies, enterprises, and institutions of state ownership, as well as notaries and state registrars, are obliged to use QES keys exclusively on secure media. At the same time, commercial organizations have the right to independently choose how to store their keys (e.g., on a PC hard drive or a flash drive), unless otherwise stipulated by amendments to the legislation on electronic trust services.

Why is this important for Ukrainian businesses?

  • Legal Compliance: Understanding the requirements for QES storage helps businesses comply with legislation, especially when interacting with government entities and regulatory bodies.
  • Enhanced Security: The use of QES ensures a high level of protection for electronic documents and transactions, which is critical for the B2B segment where data confidentiality and integrity are paramount.
  • Process Optimization: Applying QES simplifies and speeds up document flow, reducing bureaucracy, increasing operational efficiency, and enabling faster deal closures and information exchange.

You can verify the validity of your QES certificate on the website of the Central Certification Authority.
