Mutual Recognition of Qualified Electronic Signatures with the EU

Ukraine is preparing for the mutual recognition of qualified electronic signatures (QES) with the EU, opening new avenues for international business collaboration.

The publication Deals has released an article highlighting the importance of qualified electronic signatures (QES) for successful business operations with European partners. It emphasizes that QES is equivalent to Ukrainian electronic signatures and plays a crucial role in the mutual recognition of documents between Ukraine and European Union countries.

Ukraine is actively working on implementing EU legislation in the field of electronic identification and trust services. Specifically, Cabinet of Ministers Resolution No. 1311 of November 22, 2022, initiated an experimental project for the mutual recognition of QES. The Ministry of Digital Transformation of Ukraine is responsible for the technical implementation of this project, which is planned to be completed by August 20, 2024. At a meeting organized by the ICT Committee of the Union of Ukrainian Entrepreneurs, Dmytro Kotelevets, a representative of the Ministry of Digital Transformation, stressed the mandatory use of QES for the security and legal validity of documents when interacting with European partners.

For Ukrainian businesses and the Intecracy Group audience, these changes offer significant advantages:

  • Streamlined International Document Flow: QES ensures the legal validity of electronic documents, significantly accelerating and simplifying data exchange with European companies.
  • Enhanced Security and Trust: The use of QES guarantees a high level of security and document authenticity, which is critical for international agreements.
  • Compliance with EU Integration Requirements: Proactive preparation and transition to QES enable Ukrainian companies to meet European standards and successfully integrate into the EU’s single digital market.

It is recommended to regularly review electronic document management requirements and relevant legal norms for successful cooperation with European partners.
