Mandatory Electronic Court: Challenges and Solutions for Business
This article from Deals discusses the mandatory use of the Electronic Court system for legal entities and offers solutions for effective integration.
Deals has published an article focusing on the mandatory use of the ‘Electronic Court’ subsystem within the Unified Judicial Information and Telecommunication System (UJITS) for legal entities. According to Ukrainian Law No. 3200-IX dated June 29, 2023, registration and use of electronic cabinets in UJITS became mandatory for lawyers, notaries, and other participants from October 18, 2023. As of February 20, 2024, this requirement extended to private law legal entities involved in civil and administrative cases.
The Electronic Court offers several advantages, including the ability to submit documents online from anywhere in the world, streamlined processes, and faster receipt of court decisions. However, the system also presents certain drawbacks and technical specificities that require adaptation. Failure to comply with the electronic cabinet registration requirement can lead to procedural consequences, such as a lawsuit being left without movement.
In the context of mandatory Electronic Court usage, integration with Electronic Document Management (EDM) systems becomes particularly relevant. While numerous automation tools are available on the market, not all EDM systems provide adequate connectivity with the court’s electronic cabinet. Specialized solutions, such as the ‘Electronic Court Connector’ from Intecracy Group, exist to address this challenge. This UJITS add-on enables not only document exchange with courts but also facilitates comprehensive document management for legal departments or law firms.
Such a solution can benefit Ukrainian businesses and the Intecracy Group audience for several reasons:
- Ensuring Legal Compliance: It helps legal entities meet the mandatory requirements for registering and using electronic cabinets in UJITS, thereby avoiding potential procedural penalties.
- Optimizing Legal Processes: Integrated EDM systems with an Electronic Court connector allow for the automation of routine operations, collaborative case work, deadline control, and analytical reporting, significantly enhancing the efficiency of legal departments.
- Improving Security and Control: The solution offers features for distributing access rights to court cases, ensuring that confidential information is accessible only to authorized users.
