E-Signature: Requirements and Benefits for Ukrainian Business
The use of electronic signatures is crucial for effective interaction with the electronic court and other government services, particularly for specific business entities.
The media outlet Deals recently published an article focusing on the importance and specifics of using electronic signatures (e-signatures) in the context of working with the electronic court system. This topic is relevant for many Ukrainian businesses and professionals, as e-signatures play a key role in digitizing document flow and interaction with state institutions.
According to the Law of Ukraine “On Electronic Trust Services,” an electronic signature is electronic data that confirms the identity of the signatory and guarantees the integrity of the signed document. It holds the same legal validity as a handwritten signature, ensuring authenticity, protection against alteration, and the inability to disavow obligations. E-signatures can be obtained from qualified electronic trust service providers by submitting necessary documents, such as a registration card, a copy of a passport, and a taxpayer identification card. The validity period of e-signature keys is typically up to two years.
For Ukrainian businesses and the Intecracy Group audience, understanding the mechanisms of working with e-signatures is critically important for several reasons:
- Mandatory for Certain Entities: Lawyers, notaries, private enforcement officers, forensic experts, state bodies, local self-government bodies, and economic entities in the state and communal sectors of the economy are required to register official electronic addresses in the Unified Judicial Information and Telecommunication System (EJITS), which is impossible without an e-signature.
- Efficiency and Security: E-signatures ensure the legal validity of electronic documents, their integrity, and protection against forgery, which is fundamental for record-keeping and judicial processes. This significantly speeds up interaction with government agencies and courts.
- Process Optimization: The ability to submit documents online substantially reduces bureaucratic burden, saving time and resources previously spent on paper document flow and in-person visits.
The use of electronic signatures is an integral part of modern digital infrastructure, promoting transparency and efficiency in interactions between business and the state.
