Ukraine’s Electronic Court System: Key Changes for Business
Ukraine is implementing a unified judicial information and telecommunication system (ESITS), significantly altering how businesses interact with the judicial system.
The publication Deals has released an article detailing the implementation of Ukraine’s Unified Judicial Information and Telecommunication System (ESITS), which effectively represents the electronic court. This system, established in accordance with Law No. 2147-VIII, aims to automate and digitize a substantial portion of judicial processes, directly impacting the operations of Ukrainian businesses.
ESITS mandates the registration of all procedural documents, ensures automatic case and judge assignment, and facilitates electronic document exchange between courts and parties involved. Court decisions and other documents will be sent to official electronic addresses. Lawyers, notaries, government bodies, and state-owned or municipal enterprises are required to register such addresses within the system. Other entities, including private businesses, can do so voluntarily. The system also allows for the submission of procedural documents in electronic form using an electronic digital signature.
Particular attention is given to the concept of “electronic evidence”, which is now officially recognized and can be submitted to court in its original form or as an electronic copy certified by an electronic digital signature. This includes text documents, images, videos, audio recordings, websites, and other digital data. If a copy is submitted, the court may request the original.
